This page explains your right to opt out of the sale or sharing of your personal information, and how to exercise that right with Emberly.

WHY THIS PAGE EXISTS

As described in our Privacy Policy, we collect personal information from your interactions with us and our website, including through cookies, tracking pixels, and similar technologies. We share certain personal information with third parties — including advertising partners such as Meta (Facebook and Instagram) and Google — to show you ads on other websites that are more relevant to your interests, to measure the effectiveness of our advertising, and for other purposes described in our Privacy Policy.

Under certain U.S. state privacy laws — including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the Colorado Privacy Act, the Connecticut Data Privacy Act, the Virginia Consumer Data Protection Act, and similar laws in other states — this sharing of personal information for cross-context behavioral advertising may be considered a "sale," "sharing," or "targeted advertising."

Depending on your state of residence, you have the right to opt out of these activities.

CATEGORIES OF PERSONAL INFORMATION WE SHARE FOR ADVERTISING

In the past 12 months, we have shared the following categories of personal information with advertising partners for the purpose of targeted advertising:

  • Internet or other electronic network activity information — including browsing history on our site, pages viewed, products viewed, time spent, and interaction with our advertisements
  • Commercial information — including products purchased, considered, or added to cart
  • Inferences — including inferences drawn from the above categories to create a profile reflecting your preferences and behavior

We do not sell or share sensitive personal information, financial account numbers, government identifiers, or precise geolocation data.

HOW TO OPT OUT

You can opt out of the sale or sharing of your personal information for targeted advertising in any of the following ways:

1. Use Our Cookie Preferences Tool

Click the "Privacy Settings" or "Cookie Preferences" link in the footer of our website at any time to manage your tracking preferences for the device and browser you are using. Disabling "Targeting" or "Advertising" cookies will stop the sharing of your information with advertising partners on that device and browser.

2. Enable Global Privacy Control (GPC)

If you visit our website with the Global Privacy Control opt-out preference signal enabled, we will treat this as a valid request to opt out of activity that may be considered a "sale" or "sharing" of personal information, or any use that may be considered targeted advertising, for the device and browser you used to visit our website. Most major browsers and privacy extensions support GPC. You can learn more at globalprivacycontrol.org.

Please note that GPC opt-outs are tied to the specific device and browser. If you use multiple devices or browsers, you will need to enable GPC on each one.

3. Email Us Directly

You can submit an opt-out request by emailing us at support@myemberly.com with the subject line "Opt Out of Sale/Sharing." Include the following in your email:

  • Your full name
  • The email address associated with your account or order (if applicable)
  • The state in which you reside
  • A clear statement that you wish to opt out of the sale or sharing of your personal information

We will process your request within 15 business days. We may need to verify your identity before processing the request — this protects you from unauthorized opt-outs made by someone else. Verification will typically involve matching your email and information to records we hold.

4. Opt Out Through Advertising Partners Directly

You can also opt out of targeted advertising through the platforms that serve our ads:

  • Meta (Facebook and Instagram): Settings → Ads → Ad Preferences
  • Google: myaccount.google.com/data-and-privacy
  • Industry-wide opt-outs: Digital Advertising Alliance at optout.aboutads.info, Network Advertising Initiative at optout.networkadvertising.org

AUTHORIZED AGENTS

You may designate an authorized agent to submit an opt-out request on your behalf. The agent must provide written proof of your authorization (such as a signed Power of Attorney or written permission), and we may contact you directly to verify the request. Authorized agent requests should be sent to support@myemberly.com with the subject line "Authorized Agent Request — Opt Out."

OUR COMMITMENT TO NON-DISCRIMINATION

We will not deny you our products or services, charge you a different price, or provide you with a different level or quality of service because you exercised your opt-out rights. Your decision to opt out has no effect on your eligibility to purchase from us, on our 90-day money-back guarantee, or on the quality of customer support you receive.

WHAT OPTING OUT DOES AND DOES NOT DO

Opting out will:

  • Stop us from sharing your personal information with advertising partners for the purpose of targeted advertising
  • Stop our advertising partners from using your information to show you personalized Emberly ads
  • Apply to the device and browser on which you submitted the request (unless you submit a verified account-level opt-out via email)

Opting out will not:

  • Stop us from collecting information necessary to fulfill your order or operate our website
  • Stop you from seeing Emberly ads — you may still see our ads, but they will not be personalized based on your activity
  • Apply automatically to other devices or browsers you use (you must opt out on each one, or submit a verified account-level request)
  • Affect transactional communications about your existing orders

OTHER PRIVACY RIGHTS

In addition to the right to opt out, you may have other rights under your state's privacy law, including the right to know what personal information we collect, the right to correct inaccurate information, the right to delete your personal information, and the right to limit the use of sensitive personal information.
